Successful Representation of Kolon against DuPont in U.S. Patent Litigation

Lee & Ko’s IP Practice Group acted as legal advisors to Kolon Industries in connection with successfully obtaining a court decision overturning a lower court decision that had awarded DuPont a USD 919.9 million compensation judgment against Kolon Industries.  The plaintiff in the case, E.I. du Pont de Nemours and Company (“DuPont”), holds a significant market share in the field of para-aramid fibers, which are used in manufacturing bulletproof vests, among other things.  In February 2009, DuPont brought a civil action against Kolon Industries in the District Court for the Eastern District of Virginia alleging misappropriation of DuPont’s trade secrets relating to para-aramid fibers.  In response to the USD 919.9 million damages award against Kolon Industries by the District Court in September 2011, Lee & Ko assisted Kolon Industries in petitioning the U.S. Court of Appeals in Richmond, Virginia to overturn this award. On April 2014, the Circuit Court overturned the District Court’s judgment and remanded the case for a new trial.  Throughout the appeal, Lee & Ko actively assisted Kolon in all facets of the appeal, and also, led the settlement negotiations with DuPont.
