Successful Representation of Samsung Electronics in Obtaining Strategically Significant Patent Ruling and Settlement against Apple Inc.

Samsung Electronics reached a settlement with Apple Inc. on August 6, 2014 with regard to a case that had been on appeal with the Seoul High Court relating to a permanent injunction granted in Samsung’s favor by the Seoul Central District Court two years earlier.
Lee & Ko’s IP Practice Group, which has been advising and representing Samsung Electronics in connection with various smartphone-related IP disputes that have arisen between Samsung and Apple in numerous jurisdictions around the globe, was instrumental as legal counsel in obtaining the strategically important ruling from the Seoul Central District Court on August 24, 2012 in Samsung’s favor.  The ruling recognized Samsung’s claims and awarded permanent injunctive relief for Samsung in the patent infringement action that had been filed in the court against Apple’s infringement of Samsung’s standard-essential patents pertaining to wireless data communication used in producing the “iPhone” and “iPad” mobile devices.  Notwithstanding the complexities of FRAND-related antitrust and competition policy issues raised in the case, the District Court’s ruling was ultimately grounded on a detailed analysis of the parties’ course of conduct during relevant licensing negotiations. This ruling was particularly notable as it marked the first instance in which Samsung was able to procure an injunction and damages on standard-essential patent claims and established a particularly strong bargaining position for Samsung in the settlement negotiations that followed.
