Apple’s iPhone and iPad Infringe Samsung Electronics’ Standard Essential Patents

On August 24, 2012, Seoul Central District Court rendered a decision finding that Apple’s iPhone, iPad, etc. infringe Samsung Electronics’ standard essential patents and enjoined Apple from selling iPhone, iPad, etc. along with a destruction order. The court also ordered Apple to pay damages to Samsung Electronics for the infringement (Seoul Central District Court Decision, Case No. 2011 Kahap 39552, rendered August 24, 2012).

On April 15, 2011 Apple announced that negotiations on patent dispute with Samsung Electronics broke down and filed a patent infringement action against Samsung Electronics at the Northern District Court of California. In response, Samsung Electronics filed a patent infringement action against Apple at the Seoul Central District Court on April 21, 2011. As a mobile phone manufacturer, Samsung Electronics holds a number of standard essential patents, and as a leader in the smartphone market, Apple holds a number of smartphone related patents. The disputes between Samsung Electronics and Apple began being referred to as the “Patent War.” Samsung Electronics and Apple thereafter expanded the map of the Patent War by each filing actions in various jurisdictions, including Japan, Germany, the Netherlands, Italy, UK, and Australia.

In Korea, Lee & Ko represented Samsung Electronics utilizing their expertise in patent litigation combined with in-depth understanding of the complex technology involved as well as the latest legal principles relating to issues such as the FRAND issue. Lee & Ko had carefully formulated its assertions that ultimately persuaded the Seoul Central District Court to find for Samsung Electronics deciding that Apple’s iPhone, iPad, etc. infringe Samsung Electronics’ standard essential patents and ordering an injunction, destruction, and damages against Apple.
